1.Brief
During a seventh-grade hallway transition, two students have a physical altercation. Student A, who has an IEP and a behavior intervention plan (BIP), pushes Student B. Student B pushes back and falls. Staff separate them, seek appropriate medical attention, and arrange supervision. No weapon or drug is reported; the initial facts do not establish serious bodily injury within the legal exception. Those facts must be verified, not assumed. Student B's caregiver arrives angry and frightened: “This has happened before. I want that child expelled, or I want a superintendent's suspension. My child should not have to be afraid to come to school.” The initial account is incomplete. One adult witnessed the push but not the interaction before it. Student A reports being teased. Student A's caregiver says the agreed transition support has not always been provided. The paraprofessional's assignment record and the BIP implementation log have not yet been reviewed. You must address both children's immediate safety and educational needs while determining the facts and the applicable process.
Known facts
Student A (IEP and BIP) pushed Student B; Student B pushed back and fell.
Staff separated the students, sought medical attention and arranged supervision.
No weapon or drug is reported.
One adult saw the push but not what came before it.
Unknowns
What happened before the push, including the reported teasing.
Whether the documented transition support was provided that day.
What the paraprofessional's assignment record and the BIP implementation log show.
Whether the injury facts change the analysis — verify, do not assume.
Constraints
A caregiver's request is not a disciplinary decision; principal and superintendent suspensions follow different procedures [S12].
Removal history and disability safeguards are reviewed before a removal decision, not after [S13, S14].
Do not disclose either child's records to the other family [S3].
Use fictional information only. No real IEPs, diagnoses, witness statements or student names.
Adult observation: saw Student A push Student B; did not see the interaction before it.
Student A's account, obtained separately: reports being teased beforehand.
Student B's account, obtained separately: reports being pushed without warning and being afraid.
BIP excerpt (fictional): “Provide the documented transition support and teach/rehearse an agreed help-seeking routine.” No diagnosis is given, and nothing here implies a disability explains the incident.
Roles and bargaining units
Titles and units are distinct. Rights for one title do not carry to another.
May give factual observations and authorized supervision; not an assumed replacement for mandated paraprofessional support.
Students A and B and their caregivers

Student disciplinary safeguards apply regardless of which union represents an involved adult.

Applicable rules and limits

Use A-443 and the applicable Discipline Code to verify authorized responses, notifications, conferences/hearings and education during suspension. A principal's suspension and a superintendent's suspension have different procedures; the principal does not unilaterally issue the latter. The public overview describes principal suspensions of one to five school days and a hearing opportunity for superintendent suspensions.[S12]
NYCPS Behavior Supports guidance lists MDR triggers including more than 10 consecutive school days, more than 10 total school days within a 40-school-day period, and more than 10 in a school year where removals form a pattern. The revealed history requires prompt special-education/suspension review; do not authorize the proposed removal first and check later. Not every 11th cumulative day is automatically the same legal trigger — the type, timing and pattern matter.[S13]
IDEA requires an MDR within 10 school days of a disciplinary decision that changes placement. It asks whether the conduct had a direct and substantial relationship to the disability, or was the direct result of failure to implement the IEP. Removal-pattern and continuing-service requirements must also be reviewed.[S14][S15]
If the conduct is determined to be a manifestation, follow the applicable return-to-placement and FBA/BIP requirements and exceptions. Neither the principal alone nor this app makes that determination. The ordinary altercation described does not establish the narrow weapons/drugs/serious-bodily-injury exception; consult the full rule if facts change. Disability-related conduct does not make all discipline prohibited.[S14]
Student information remains confidential under A-820. Explain measures for Student B's safety without disclosing Student A's diagnosis, IEP, disciplinary record or placement. Communicate separately with each family.[S3]
Informal removals — including “voluntary” early pickups staff requested or effectively required — must be reviewed as possible removals, not used to bypass procedures.[S15]
Staff: if a review of support implementation becomes an employee disciplinary investigation, apply the relevant employee protections; do not presume misconduct from a missing log entry. Employee investigation procedures (such as A-421's 48-hour notice) are separate from student suspension procedures. Safety response and student procedural requirements must not await labor negotiations.[S6][S7][S8]

Choose a first move at the decision checkpoint, then explain your reasoning. For each person in the dialogue, include a concrete safety measure, the relevant decision-maker or process, and a follow-up commitment. Do not promise another child's placement or disciplinary outcome.

Student B's caregiver demands expulsion or a superintendent's suspension. What is your first move?

5.H.U.M.A.N. reflections
How will you acknowledge both families' concerns and preserve both students' dignity and access to learning?
General lens: Whose account have you not yet heard, and how will you make it safe for them to disagree with you?
What facts, removal records and IEP/BIP implementation evidence are missing, and who must review them?
General lens: What information or tool output are you relying on? How did you check its source and limits, and who owns the final judgment?
What staff coverage, training and coordinated support are needed for safe participation?
General lens: Whose capability is visible here — and whose might be overlooked? What opportunity or development follows?
How will you prepare the AP and team to recognize escalation points and follow the correct process?
General lens: What routine, timeline or coaching support would make your plan workable in a real week?
What will you communicate today and tomorrow, and how will you monitor whether the plan works?
General lens: What is changing for the people involved? How will they give input, and when would you adjust course?
2a: respectful interactions and dignity; 2d: explicit expectations and preventive behavior supports; 1e: coherent plans for transitions and access to instruction. These are reflective leadership connections, not grounds for a teacher rating from this incident. Danielson does not determine suspension eligibility, disability manifestation, or an aide's or AP's performance rating.
